The Age Discrimination in Employment Act (“ADEA”) and state laws in Pennsylvania and New Jersey prohibit discrimination on the basis of age. Under the ADEA, individuals who are over 40 years of age are protected from being terminated, demoted or otherwise discriminated against because of their age. The ADEA also protects individuals over 40 years of age who are not hired for a position on the basis of their age or who are subjected to a hostile work environment because of their age. Under New Jersey law, an employer may not make decisions on the basis of your age regardless of how old you are.
