FAMILY AND MEDICAL LEAVE ACT


The Family and Medical Leave Act (“FMLA”) provides eligible employees with up to 12 weeks of unpaid leave per year and requires that an employer maintain group health benefits for the employee during eligible leave. Not all employers are covered by the FMLA and employees must be employed with their employer for at least one year in order to receive FMLA leave. Eligible employees may receive up to 12 weeks of unpaid leave per year in the event of certain medical problems, pregnancy, or the need to care for a family member with certain medical problems.  The FMLA mandates procedures that employees must follow to receive and maintain leave, and also provides for protection against retaliation for employees who request FMLA  leave. If you are employed in New Jersey, you may be entitled to additional leave rights under state law.
